Terms of Use Introduction

Our online store welcomes you and informs you that the terms and conditions governing your use of this store, as well as all legal consequences arising from your use of the store's services through this electronic platform, are set out below.

The use of this store by any person, whether as a consumer of the store's services or products or otherwise, constitutes their acknowledgment, acceptance, and agreement, while possessing full legal capacity under Sharia, regulations, and applicable laws, to all the terms and provisions of this Agreement. It also confirms their commitment to comply with its rules and conditions.

This Agreement applies to all types of transactions conducted between the consumer and the store. The Agreement shall become effective and binding immediately upon your acceptance of it and the commencement of your registration with the store, in accordance with Article 10 of the Saudi Electronic Transactions Law.

Introduction and Definitions

The above preamble forms an integral part of this Agreement. The following terms and expressions shall have the meanings assigned to them below whenever used in this Agreement:

1. Store: This term includes all forms of the store operating through the Internet, whether as a mobile application, a website, or a physical commercial establishment.
2. Consumer: Any person who engages in electronic commerce for the purpose of obtaining products or services offered by the Store through its electronic platform.
3. Agreement: This term refers to the terms and conditions set forth herein, which govern and regulate the relationship between the parties to this Agreement.

Consumer Legal Capacity

• The Consumer acknowledges that they possess the legal capacity required under applicable laws and regulations to engage in transactions with the Store, or that they are at least eighteen (18) years of age.
• The Consumer agrees that, in the event of any violation of the provisions of this Article, they shall bear full responsibility for the consequences of such violation toward third parties.

Nature of the Store’s Obligations  

• The Store's obligation toward Consumers is limited to providing the requested products and/or services.
  
  
• The Store may, at its discretion and depending on the nature and type of the product or service requested by the Consumer, provide additional services such as after-sales support or other related services.

Terms of Use

• The Consumer agrees to use the Store’s electronic platform in a manner that complies with public morals, public order, and all applicable laws and regulations of the Kingdom of Saudi Arabia.
  
  
• When purchasing any product or service from the Store, the Consumer agrees not to use such product or service in any manner that violates public morals or the laws and regulations in force in the Kingdom of Saudi Arabia.

Accounts and Registration Obligations  

• Upon applying for membership in the Store as a user, you are required to provide specific information and choose a username and a confidential password to be used when accessing the Store’s services. By doing so, you agree to the following:
• • You are responsible for maintaining the confidentiality of your account information and password. You also agree to immediately notify the Store of any unauthorized use of your account information or any other breach of your confidential data.
  • Under no circumstances shall the Store be liable for any loss, whether direct or indirect, moral or material, resulting from the disclosure of your username or login credentials.
  • You agree to use your account or membership personally, and you bear full responsibility for it. Any use by another party shall be considered as authorization granted by you to use the Store under your name and on your behalf.
  • You agree to use the Store in a serious and truthful manner.
  • You agree to provide true, accurate, current, complete, and lawful information about yourself as required during registration, and to update your information whenever it changes or when necessary.
  • The Store is committed to treating your personal information and contact details with strict confidentiality.
  • If it is found that you have provided untrue, inaccurate, outdated, incomplete, or unlawful information, or information that violates this Terms of Use Agreement, the Store reserves the right to suspend, freeze, or cancel your membership or account on the platform, without prejudice to its other rights and lawful means to recover its rights and protect other consumers.
  • In the event of any failure to comply with the above, the Store administration has the right to suspend, cancel, or block your account or membership, and prevent you from accessing the Store’s services again.

Electronic Communications and Official Communication        Channels  

• The parties to this Agreement agree that communication shall take place through the email address registered on the platform.
• The Consumer agrees that all agreements, advertisements, statements, and other communications provided electronically shall have the same legal effect as their written counterparts and shall constitute independent evidence for fulfilling legal and regulatory requirements.
• The Consumer agrees that the Store may communicate with them and notify them of any provisions related to this Agreement or their transactions by sending general messages to all Consumers or to specific users of the Store.

Amendments to the Terms of Use and Fees  

• In the event that any provision or clause contained in this Agreement is cancelled or becomes invalid, such cancellation or invalidity shall not affect the validity of the remaining provisions, clauses, rules, and terms of this Agreement, which shall remain in full force and effect until further notice from the Store’s management.
• This Agreement, as amended from time to time as necessary, constitutes the framework governing the operation, understanding, and agreement between the Consumer and the Store.
• The Store may impose fees on certain Consumers depending on the offers, products, or services requested, or as required by the state in terms of applicable taxes or charges related to the nature of the product or service.
• The Store reserves the right to add, increase, decrease, or deduct any fees or charges in accordance with the provisions of this Agreement, for any Consumer regardless of the reason for their registration.

Payment and Settlement Services for Stores on the  latform  

• The Store provides, through its partners, payment and settlement systems within the platform. Payment may be made entirely online through the payment options available on the Store or through any other payment method that may be provided by the Store from time to time.
• The Store undertakes to set the price of any service or product offered on its platform in accordance with the prevailing market value.
• The Store is committed to issuing invoices, receipts, and delivery/receipt notes for all amounts and revenues generated through its store, and shall provide the Consumer with a purchase invoice for any service or product purchased.
• The Store is committed to maintaining generally accepted accounting standards within its electronic store, in implementation of the provisions of this Agreement and in consideration of its legal, economic, commercial, and regulatory interests.

Intellectual Property

• All intellectual property rights related to the Store are fully owned by the Store, whether such rights existed prior to the establishment of this electronic platform or arose thereafter.
• The Consumer acknowledges and agrees to respect the Store’s intellectual property rights, including but not limited to the Store’s name, as well as all words, logos, and other symbols belonging to or displayed on the Store. All rights associated with the Store’s name and identity constitute fully protected intellectual property owned exclusively by the Store.

Store Liability

• The Store undertakes to conduct its commercial activities through this electronic platform in a lawful manner and in compliance with the applicable laws and regulations of the Kingdom of Saudi Arabia, as well as the provisions of this Agreement.
• The Store shall not be held liable for any claims arising from errors or negligence, whether direct, indirect, incidental, or resulting from the Consumer or third parties such as shipping companies.
• The Store, its employees, owners, and representatives undertake that all products or services offered are lawful, legitimate, and authorized under the laws and regulations of the Kingdom of Saudi Arabia, and that they are intended for lawful use.

Restriction of Access or Membership

The Store may, at any time and without prior notice and for any reason whatsoever, suspend, terminate, or restrict the Consumer’s membership or access to the platform’s services, without limitation.

Governing Law 

This Terms of Use Agreement is governed by and construed in accordance with the laws, regulations, and legislation in force in the Kingdom of Saudi Arabia. It is fully and exclusively subject to the applicable laws and regulations of the competent authorities within the Kingdom of Saudi Arabia.  

General Provisions

In the event that any provision or clause contained in this Terms of Use Agreement is cancelled, or if any provision or clause becomes invalid, such cancellation or invalidity shall not affect the validity of the remaining provisions, clauses, and terms of this Agreement, which shall remain in full force and effect until further notice from the Store’s management.

This Terms of Use Agreement, as may be amended from time to time as necessary, constitutes the Agreement, framework, understanding, cooperation, and contractual relationship between the Store and the Consumer. Both parties agree that the following shall be taken into consideration:

• The Arabic language shall be the governing language for interpreting the provisions of this Agreement, or when translating it into any other language.
• All prices displayed for the Store’s products or services may be subject to change from time to time.
• Promotional or marketing offers provided by the Store are temporary, and the Store reserves the right to amend or discontinue such offers at any time.
• The parties to this Agreement shall conduct their dealings in compliance with Sharia principles and applicable laws and regulations relevant to the nature of the relationship between the Store and the Consumer.
• This Terms of Use Agreement shall only be terminated by a decision issued by the Store’s management.
